Dark Patterns, Power, and the Erosion of Consent

How AI supercharges manipulative design — and why governance must catch up

Every digital product is designed. Every design makes choices. And every choice either serves the user — or serves the organization at the user's expense. The term for the latter is dark patterns: interface and system designs that manipulate users into taking actions they would not freely choose if they understood what was happening.

Dark patterns are not new. But the combination of AI, behavioral data, and personalization has given them unprecedented reach and sophistication. What was once a clumsy checkout trick — a pre-checked box for an unwanted newsletter — is now a system that can model an individual's psychological vulnerabilities and deliver a precisely calibrated nudge at the moment of lowest resistance.

This article examines dark patterns in the context of AI governance, the regulatory frameworks addressing them, and why organizations that rely on them are building on a foundation that will not hold.

What Dark Patterns Actually Are

Academic literature on dark patterns originates in user experience and human-computer interaction research. A widely cited definition from Luguri and Strahilevitz (2021), published in the Journal of Legal Analysis, describes dark patterns as interfaces that "knowingly confuse users, make it difficult for users to express their actual preferences, or manipulate users into taking certain actions." The key element is the manipulation of decision-making through design — not through force, but through exploitation of cognitive shortcuts, time pressure, and information asymmetry.

Common examples include: subscription services that are easy to join and deliberately difficult to cancel; cookie consent banners that prominently display "Accept All" while burying "Reject All" in secondary menus; pre-checked boxes that enroll users in paid add-ons; and urgency signals — "Only 2 left!", "This offer expires in 10 minutes!" — that create artificial time pressure to prevent deliberation.

The FTC has defined dark patterns within its framework of unfair or deceptive practices under Section 5 of the FTC Act, noting that practices that "obscure material information, create false urgency, or impede consumers' ability to cancel" meet the statutory threshold for deception regardless of the technology through which they are delivered (FTC, 2022).

AI Supercharges the Problem

Traditional dark patterns operated at the level of interface design — they were applied uniformly to all users. AI-powered dark patterns are different in a way that raises the ethical stakes substantially: they can be personalized.

Machine learning systems trained on behavioral data can identify, at an individual level, which users are most likely to respond to price anchoring, which are most susceptible to social proof, and which are most likely to abandon a cancellation flow if an emotional retention message is delivered at the right moment. This level of behavioral targeting is not hypothetical — it is standard practice in subscription businesses, e-commerce, and social media platforms.

The EU AI Act specifically addresses AI systems that "deploy subliminal techniques beyond a person's consciousness" or that "exploit any of the vulnerabilities of a specific group of persons" — classifying such systems as posing unacceptable risk and prohibiting them outright (European Parliament, 2024). The Digital Services Act, which came into force in 2024, adds obligations for large online platforms to prohibit interface designs that "deceive or manipulate" users, with significant enforcement penalties.

In the United States, the FTC's 2022 report, Bringing Dark Patterns to Light, documented dozens of specific dark pattern practices and signaled that enforcement action would follow (FTC, 2022). The Children's Online Privacy Protection Act (COPPA) rules specifically prohibit dark patterns used to obtain consent from or regarding children.

Consent That Isn't Really Consent

The dark pattern problem intersects directly with the consent problem — and nowhere is this more consequential than in AI governance. AI systems depend on data. Data collection depends on consent. And if that consent is obtained through manipulation rather than meaningful choice, the ethical foundation of the entire system is compromised.

The GDPR, which remains the baseline data protection standard for organizations operating in or serving EU markets, requires that consent be "freely given, specific, informed, and unambiguous" (European Parliament and Council, 2016). A consent obtained through a dark pattern — where the "agree" button is large and prominent and the "decline" option requires three additional steps — does not meet this standard.

ISO/IEC 42001:2023, the AI management system standard, extends this principle to AI specifically, requiring that organizations document the basis on which training data was collected and ensure that data subjects' rights — including the right to meaningful, unpressured consent — were respected (ISO, 2023). This creates a governance obligation that runs upstream from AI deployment to data collection practices.

The Power Asymmetry at the Heart of the Problem

Dark patterns are fundamentally an expression of power asymmetry. The organization designing the interface has more information, more technical capability, and more resources than the individual interacting with it. That asymmetry creates a responsibility — not merely a legal one, but a moral one.

Deontological ethics holds that this responsibility does not dissolve because market incentives point in the other direction. Kant's categorical imperative — roughly, act only in ways you would will to be universal — applied to digital design asks: if every company designed interfaces this way, would users be better or worse off? The answer, consistently, is worse. And that is sufficient to identify the practice as ethically impermissible regardless of its revenue impact (Kant, 1785).

Contractarian ethics offers a complementary test. Rawls's veil of ignorance asks: what design principles would you agree to if you did not know whether you would be the designer or the user? No rational person would agree to a consent architecture designed to bypass their genuine preferences (Rawls, 1971). This thought experiment is not theoretical — it is the foundation of the regulatory principle that consumers have a right to meaningful choice, not the appearance of choice.

What Organizations Need to Do

The regulatory direction is clear. The ethical case is clear. What remains is the operational question: what does responsible interface and AI design actually look like in practice?

First, consent mechanisms must be evaluated not for technical compliance but for genuine effectiveness. Does a user who does not read the fine print still understand what they are agreeing to? Is the opt-out path as accessible as the opt-in path? Would a reasonable person feel informed?

Second, behavioral AI systems must be audited for manipulation. If a personalization engine is optimizing for conversion, what constraints exist to ensure it is not doing so by targeting user vulnerabilities? The NIST AI RMF's "Measure" function requires organizations to test AI systems for the harms they could cause — and psychological manipulation is a harm (NIST, 2023).

Third, the people designing interfaces and AI systems must be accountable to the people who use them. This requires governance structures in which design decisions are reviewed against ethical standards — not just legal minimum requirements — before deployment.

Trust, Built or Destroyed, Is a Design Choice

Every design choice either builds or erodes trust. Organizations that use dark patterns to optimize short-term conversion are making a long-term trade — they are extracting value from the trust relationship and spending it down.

The Edelman Trust Barometer has consistently shown that trust in technology companies is eroding, with AI as a growing source of public concern (Edelman, 2024). Regulatory enforcement is accelerating. Class action litigation over deceptive design practices is increasing. The organizations that are building durable brands are the ones that design with the user's genuine interests in mind — not as a constraint, but as a principle.

Because integrity, in design as in leadership, is not the absence of pressure. It is the presence of principle when pressure appears. And the organizations that hold that line — in how they collect data, how they design consent, and how they use AI — are the ones that will still be trusted when the regulatory and reputational dust has settled.
